1. Our app

The Workout Timer allows users to create workout programs where the user specifies durations for each workout step including warmups, work periods, rest periods and stretches.

2. Eligibility

The app can be used by people of any ages subject to the minimum age required by the App Store in your region. You must not share your account credentials with anyone else. You are responsible for keeping your login information secure.

3. Accounts

Some features require an account. You must provide accurate information when creating an account. We may suspend or terminate accounts that violate these terms or where required by law.

4. Subscriptions & payments

The app is available to use for free. Optional premium features are available via monthly or annual subscriptions. All payments and subscription management (including billing, renewals, cancellations, and refunds) are handled by Apple through the App Store. By subscribing you agree to Apple’s terms and the App Store subscription practices.

• Auto-renewal: Subscriptions auto-renew unless cancelled in your Apple account settings before the renewal date.
• Refunds: Refunds are handled by Apple. Contact Apple Support for refund requests.
• Free trial: Upon the first subscription, users are eligible for a free 30-day trial. Trial terms are subject to Apple’s policies.

5. Intellectual property

The app, its design, logos, text, graphics and other content are owned by HonestyVision Limited. You may not copy, reproduce, distribute, create derivative works, or publicly display any part of the app without our prior written permission. User-generated workout content remains the property of the user; however by using the app you grant us a limited, non-exclusive license to operate and provide the service (e.g., store and retrieve your workout data in Firebase).

6. User content

You are responsible for all content you create within the app. You must not use the app to violate laws or intellectual property rights. We are not responsible for user-generated content and reserve the right to remove content that violates these Terms.

7. Privacy

Our Privacy Policy explains how we collect and use personal information. By using the app you consent to our processing of your data as described in the Privacy Policy: Privacy Policy (or visit https://theworkouttimer.app).

8. Disclaimers

The app is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee accuracy, reliability, or suitability of the app for your purposes. Use of the app is at your own risk. The Workout Timer is not a medical device and does not provide medical advice. Consult a physician before starting any new exercise program.

9. Limitation of liability

To the fullest extent permitted by law, HonestyVision Limited and its officers, employees, agents and suppliers will not be liable for any indirect, incidental, special, consequential or exemplary damages arising out of or related to your use of the app, even if advised of the possibility of such damages. Our total liability for claims relating to the app will not exceed the amount you have paid to us in the past 12 months.

10. Account termination

We may terminate or suspend your access to the app at any time, with or without notice, for conduct that we believe violates these terms or is harmful to other users or our business. If you wish to delete your account and data, contact us at contact@theworkouttimer.app. We may request verification to process deletion requests.

11. Changes to the Terms

We may update these Terms from time to time. When changes are made, we will revise the “Effective date” at the top. Continued use of the app after changes indicates acceptance of the updated terms.

12. Governing law

These terms are governed by the laws of England. Any dispute arising out of or relating to these terms will be subject to the exclusive jurisdiction of the courts of England and Wales, to the extent permitted by applicable law.
